Privacy Policy of HUMAN FILM SP. Z O.O.
This Privacy Policy stipulates the rules for the processing and protection of personal data obtained from the User during their use of the websites available at https://www.human.film (hereinafter referred to as “the Websites"), provided by HUMAN FILM sp. z o. o. with its registered office in Warsaw 00-718, ul. Czerniakowska 73/79, entered in the register of entrepreneurs kept by the District Court for the capital city of Warsaw In Warsaw, 13th Commercial Division of the National Court Register, entry no. 0000296905, TAX ID: 521-350-78-20, REGON: 141127547 (hereinafter referred to as "Human Film") and also any personal data processed by Human Film in connection with its business activity.
“The User”, as defined in the Privacy Policy, means an individual using the Websites or any counterparty/contractor of Human Film.
By using the Website, the User agrees to the terms and conditions set forth in this Privacy Policy.
Data Controller
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data (the "Regulation"),Human Film informs the User that it is the controller of the personal data provided by the User in relation to Human Film services provision or during their use of the Website.
Human Film is an entity affiliated with the PFX group of companies, which enables cooperation in film production and post-production within the European Union. Accordingly, the following entities may jointly administer personal data that they mutually manage in connection with ongoing projects (hereinafter “Joint Controllers”):
The above entities engage in joint data administration only in the scope of their shared production activities and the joint maintenance of HR and accounting databases, using dedicated software for these purposes. In all other respects, Human Film processes data independently as a separate controller. Salary-related data for Human Film employees are processed exclusively by Human Film.
Personal Data
Human Film processes the Users' personal data when they use or interact with the Website (e.g., as a result of submitting information via an interactive form). Personal data shall be construed as information about an identified or identifiable natural person, that is, one who can be identified directly or indirectly by an identifier such as a name, identification number, location data, or Internet identifier.
Human Film takes due care to process only the personal data that are necessary for the purpose of the processing, and to ensure its security and transparency. Human Film processes the data of both registered Users of the Websites and visitors to the Websites who use the Websites without providing identifying information.
Human Film allows the User to use the Websites without the User’s registering or logging in or providing any personal information. During such use of the Websites for informational purposes only, Human Film shall not collect any personal data, except for the information sent by the browser, which is necessary to provide technical access to the Websites. Such information includes:
The aforementioned data are used by Human Film to improve the Websites, to adapt them to the needs of the User and to more effectively remove detected malfunctions of the Websites. This information also allows the User to manage server properties in order to meet volume requirements. This information shall not be used to identify the User.
In cases where the User grants Human Film consent to process specific personal data, the legal basis for processing these data is Article 6(1)(a) of the Regulation, i.e., the User’s consent. Data processed on the basis of consent are processed only until the User withdraws that consent, with the proviso that Human Film may retain such data for periods corresponding to applicable limitation periods for the purpose of handling potential claims.
In cases where the User enters into an agreement with Human Film (including an agreement to use the Service), the legal basis for processing personal data is Article 6(1)(b) of the Regulation, namely the necessity of processing for the performance of a contract. Data processed for this purpose are processed only for the period necessary to fulfill the contract, with the proviso that Human Film may retain such data for periods corresponding to the relevant limitation periods in order to handle potential claims.
In cases where it is possible to combine the above data with other data enabling the identification of a specific natural person, Article 6(1)(f) of GDPR constitutes legal basis for Human Film's processing of personal data obtained in such a way meaning that it is done in compliance with Human Film's legitimate interest, i.e. in order to enable the User to access and use the Websites. The processing of these data is also in the interest of the User, as it allows them to use the Websites. Data processed on the basis of legitimate interest are stored and processed by Human Film for a period of five years, after which they are deleted.
Human Film may process the User's data in accordance with its legitimate interest to:
Human Film shall retain the Users' personal data only for as long as is necessary to fulfil the purposes for which the data were collected. After this time, the data shall be deleted or anonymised in a way preventing determination of the identity of the User.
Personal Data Processing and Entrustment
Entrusted with the processing of the User's personal data or other data referred to in the Privacy Policy, on the basis of a written agreement and in accordance with the provisions of the Regulation, may be entities providing services to Human Film, such as hosting, administration, maintenance and management of the Website.
Subject to the above provisions, the collected personal data shall not be disclosed to any other persons or institutions, unless required by applicable law or necessary for the purpose of personal data processing, provided that an appropriate agreement is concluded guaranteeing the protection of the User's rights and privacy.
Notwithstanding the above, your personal data may be shared with the Joint Administrators to the extent necessary for the pursuit of shared business objectives. Each of the Joint Administrators is required to apply a level of data protection no lower than that specified in this Privacy Policy.
Users’ personal data will not be transferred to a country outside the EEA, and if this proves necessary, such transfer will be carried out in accordance with European Commission guidelines and DPF standards.
Rights and Obligations of the User
The User has the right to access their personal data and the right to request that their personal data be supplemented, updated, transferred, rectified, their processing restricted, temporarily or permanently suspended, or to request that their data be deleted if they are incomplete, outdated, untrue, or if they were collected in violation of the law or are no longer necessary for fulfilling the purpose for which they were collected.
Human Film allows the User to remove their personal data from the dataset at the User's request or under the provisions of the Regulation.
Human Film may refuse to delete personal data if the User has violated the terms and conditions of the Website, insofar as they will apply to the User or applicable laws, and the preservation of personal data is necessary to clarify the circumstances of the violation and determine the User's liability.
The User may post any personal information of others (including their name or e-mail address) on the Websites under the condition that they do not violate the provisions of applicable law and the personal rights of such persons.
Additional Information Concerning Cookies
Cookies are text files that are stored on the disk of the User's device and are used to recognize the User's device when reconnecting to a website that uses cookies.
Cookies are not used to determine the identity of the User, but they allow to more accurately determine the individual needs of the User using a particular device, thus offering better and more customized services, as well as enabling the User to browse websites more easily.

Deletion of cookies may incapacitate some functionalities of Human Film websites.
Data Security
In order to protect the User's personal data from being obtained by unauthorized persons, being processed in violation of applicable regulations, and from being altered, lost, damaged or destroyed, technical and organizational measures are implemented to ensure the protection of the processed personal data that is appropriate to the risks and categories of data under protection.
In particular, the Company uses technical measures to prevent the acquisition or modification of data by unauthorized persons. Data provided by the User when filling in and submitting web forms is encrypted by means of SSL certificates.

Human Film reserves the right to amend the Privacy Policy and, at the same time, assures that the User's rights under this document shall not be restricted without their consent. Any amendments to the Privacy Policy shall be posted on the website available at www.human.film
Contact with the Supervisory Authorit
In all matters related to the processing of the User's personal data and the application and implementation of this Privacy Policy, the User has the right to lodge a complaint with the President of the Office for Personal Data Protection.
